1. Introduction

These Terms & Conditions (“Terms”) govern your use of the website(s), mobile application(s), and other services (collectively, “the Apps”) owned and operated by Agniverse OU (“Company,” “we,” “us,” or “our”). For clarity, the Apps currently include, without limitation, Backed, as well as any future applications or services we may develop, operate, or publish.

By accessing or using the Apps, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use of the Apps immediately.

2. Agreement to Terms

By accessing our platform (the Apps), you agree to be bound by these Terms and to comply with any applicable local laws and regulations.

Age Requirement: You must be at least 13 years of age to use the Apps. If you are under the age of 13, you may only use the Apps with the consent and active involvement of a parent or legal guardian. Geographic Scope: the Apps are accessible worldwide; we do not impose geographical restrictions on who can use them.

5. Account Creation & Security

You may create multiple accounts, provided each account is created with a unique identifier (e.g., email) and used lawfully. You are solely responsible for all activities that occur under your accounts and for maintaining the confidentiality of your login credentials. 6. User Conduct & Content

Prohibited Activities: You agree not to engage in any unlawful, harmful, or offensive conduct on the Apps, including but not limited to:

  • Posting content that is hateful, harassing, discriminatory, defamatory, or obscene
  • Violating any applicable laws or regulations
  • Uploading or sharing content that infringes third-party intellectual property rights

We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities. If you create, upload, or share any content on the Apps, you warrant that you own or have the necessary rights to such content.

Feedback & Suggestions: We may implement any feedback or suggestions you provide without compensation or acknowledgment.

7. Intellectual Property

All content on the Apps (such as text, graphics, logos, trademarks, and software) is the exclusive property of Agniverse OU or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

8. In-App Purchases & Subscriptions

Fees & Changes: the Apps may offer in-app purchases, paid features, goods, and subscription plans. All prices and fees are subject to change at any time without prior notice.

Free Trial: We may offer a free trial for certain subscription plans. The length and terms of the free trial will be stated on the subscription page. You may cancel anytime during the trial period to avoid being charged.

9. Promotions, Contests, & Sweepstakes

We may periodically offer promotions, contests, sweepstakes, or similar events. These may be governed by additional rules that will be provided when such events occur. Governing Law: These Terms and any dispute arising therefrom shall be governed by the laws of Estonia, without regard to its conflict-of-laws rules.

Exclusive Jurisdiction: Any legal action or proceeding related to these Terms or the Apps shall be brought in the courts of Estonia, and you consent to the exclusive jurisdiction of such courts.

12. Limitations of Liability & Disclaimers

Disclaimer of Warranties: the Apps are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability: To the fullest extent permitted by law, Agniverse OU, its affiliates, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Apps.

13. Indemnification

You agree to defend, indemnify, and hold harmless Agniverse OU, its affiliates, and their respective directors, officers, employees, and agents from all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from or related to your use or misuse of the Apps, your violation of these Terms, or your infringement of any third-party rights.

14. Severability & Entire Agreement

If any provision of these Terms is deemed invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect. These Terms constitute the entire agreement between you and Agniverse OU regarding the Apps, superseding any prior or contemporaneous agreements or communications.

We may update or modify these Terms from time to time. If we make material changes, we will provide notice (e.g., by posting an update on the Apps or emailing you). Your continued use of the Apps after any modifications indicates your acceptance of the revised Terms.
